Janco Toys would like to remind you to read these conditions carefully before buying anything from us, as your use of this website means you are acknowledging, agreeing to, and assenting to these Terms & Conditions, and use of this website is at your own risk. You also agree that the laws of the United Kingdom, without regard to principles or conflict of laws, will govern these Conditions, and any dispute of any sort that might arise between you and Janco Toys.
Janco Toys reserves the right to modify any part of this website, including but not limited to: prices, policies and conditions at any time.
Product Description & Representation
Janco Toys cannot always guarantee that product descriptions, prices, photographs or other content is totally accurate, complete, reliable, current, or error-free. Janco Toys is not responsible for typographical errors, supplier/manufacturer delays in delivery or changes to products. All product descriptions, variations, prices and shipping dates are subject to change and availability without notice. We reserve the right to restrict the quantity of items sold. We reserve the right to refuse any sale. If a product sold directly by Janco Toys is not as described, you should return it in unused condition within 7 working days (please read our Refunds, Returns & Replacements section below). It must, where possible, be returned inside its factory sealed packaging. Janco Toys sells products to adults aged over 18 years only when ordering though our website. If you are under 18, you may use our website only under the supervision of a parent or guardian. Janco Toys reserves the right to refuse service, terminate purchases, remove or edit content, or cancel orders at their sole discretion at any given time.
Pricing
We try to ensure that all prices shown on our web site are accurate. All prices are displayed in £ Pounds Sterling. Sometimes products/prices are displayed incorrectly. Where a product's correct price is lower than the displayed price, we will charge the correct price at the time of invoicing. Where a product's correct price is higher than the displayed price we will inform you of the correct price and give you the opportunity to proceed with the order at the correct price, or cancel the order. When an item is displayed as REDUCED, the item will have been on sale at its higher regular price for 28 days or more, either on the website, in the shop or both. SPECIAL PURCHASE items are those that we have obtained at a reduced cost in order to offer them to you at a price lower than normal retail price. Please note that prices may change without notice.
Payment
Janco Toys can accept payment using the following credit/debit cards: Visa, Mastercard, Electron, Switch/Maestro, Solo, Delta, and JCB. Other methods of payment include cheque, money order, postal order, draft, cashiers check, bank transfer, cash and PayPal. We will take payment for your order at the time we are ready to dispatch it to you. We reserve the right to charge ¼ (quarter) of goods total as a deposit (non-refundable) for some pre-orders, (please see the Pre-Order section below). If we have charged a deposit for any item or pre-order, and it fails to come into stock, then a full unconditional refund will be given. We guarantee that we will not charge your card for regular sales/services until we are ready to ship your order. All payments are to be made in £ Pounds Sterling unless another denomination has been agreed.
Occasionally item(s) you pre-order from us are subject to your being charged ¼ (quarter) of goods total (not to include shipping) at the time you place the order regardless of the due, or actual, arrival date of the item(s). Item(s) which require a deposit will be clearly indicated on the product page. The goods' balance, plus shipping fee(s), will charged at the time we ship the order. You may cancel a pre-order within 7 days of placing it without penalty. If you cancel a pre-order after 7 days we reserve the right to charge you 10% of total goods value as an administration fee. You agree to these terms and conditions by adding items to your cart and completing your checkout process online, or by your telephone order. If an item that is offered for pre-order never arrives into stock, you will be fully reimbursed.
Customs & Duty
Janco Toys accepts no responsibility for any duty or taxes that are deemed payable at the time of delivery to you. You assume and accept full responsibility for complying with, and adhering to, your local rules and import legislation. If your order has been inspected by customs or any other security personnel, having already left our premises, we accept no responsibility to replace or exchange it under any circumstances. Any product that has its original seal broken by any persons other than Janco Toys staff is the responsibility of the buyer and any risk or losses involved lies solely with the buyer. Any items returned to Janco Toys as a result of an inspection and subsequent failed delivery will be returned to us at the expense of the buyer. If the buyer requests re-shipping of the order then additional shipping charges will be applied beforehand. We will only re-ship the very same item that was returned to us.
Refunds, Returns & Replacements
All purchases and pre-orders are final, however you are able to request a refund or to cancel an order up to 7 days after your order is delivered. If you want to cancel your order or obtain a refund, the goods must be returned and received by Janco Toys in the same condition as they arrived with you. If the item(s) arrive at Janco Toys in sub-standard or non-saleable condition a refund will not be offered (unless the cause of the non-saleable condition was as a result of mis-handling by our carriers). Generally, refunds may only be issued if item(s) arrive damaged, if the wrong item(s) are shipped, or if the pre-ordered item fails to arrive from the supplier/manufacturer. All refunds will be made within 30 days or less. We also offer the facility to return unsuitable items (please see below). Damaged or incorrect merchandise must be returned and postmarked back to Janco Toys (shop address) within 10 working days of the delivery date. Transit damage claims must be notified by email or in writing within 3 days of its arrival to you. If you are making a return, it must be adequately insured and you must obtain proof of mailing. You must always email or write to us before returning any item. Janco Toys reserves the right to refuse returns if there is any doubt in the validity of any claim. Exchanges are offered at the discretion of Janco Toys and are subject to scrutiny. Exchanges will only be offered for the same or a similar item. If the original item arrives to you in sub-standard condition due to a packaging flaw, and not transit damage, it may be exchanged. All returns are dealt with in accordance with our returns procedure.
Unwanted or Unsuitable items
If you are unhappy with the product you purchased through our website (i.e. if it is unwanted) you may return it within 10 working days of the date you received it for a refund (we will not refund shipping charges) - we will charge a 10% re-stocking fee. Any refund due will be expedited within 30 days. All products must be returned in their original sealed packaging in re-saleable condition. You are responsible for the cost of returning unwanted items to us. You should use a registered/recorded delivery service to guarantee its safe arrival.
Damaged Goods
Never accept or sign-for a package that has visibly suffered damaged. If the damage is only apparent after opening the package please contact us as soon as possible. All items purchased from Janco Toys are made pursuant to a shipment contract. This means that the title for such items and risk of loss pass to you upon our delivery to the carrier. All orders are insured at a basic level of £25-£100 per package dependent on the method of carriage. Janco Toys will endeavour to recover on your behalf, any monies due from our carrier in the event of transit damage. For your peace of mind we offer additional insurance cover at a premium. We obtain proof of mailing for every order. Janco Toys takes pride in its excellent packaging skills and expects less than 0.2% of orders to sustain transit damage.

Security
Janco Toys will take all reasonable care to protect the personal and payment details that you provide, but we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from our website.
Unsolicited Emails
Janco Toys will not send unsolicited email(s) unless we have your consent or unless we need to contact you for another specific reason relating to an order or request. You may add your name to our mailing list on our main shopping page or after checkout, and you may remove yourself from the list by asking us to remove you or by clicking the link displayed in any email you receive from our mail shot server. We will never provide your details to another party.

All layouts, images, characters, photographs, text, graphics and logo's are protected by United Kingdom and International copyright laws. The arrangement, presentation and nature of this website are the exclusive property of Janco Toys, and are protected by UK and International copyright laws - ALL RIGHTS RESERVED. Failure to comply with UK and International copyright laws will result in immediate legal action. Use of Janco Toys’ images, content, layouts, concepts and the like by individuals developing websites with intent to gain, is unequivocally illegal unless a license and written permission from Janco Toys has been obtained prior to use.

This website is owned and maintained by Janco Toys, and you are allowed limited access for personal, non-commercial use. Downloading (other than normal browser caching) and modifying is strictly prohibited unless you are granted express written consent by Janco Toys. No elements of the Janco Toys website may be modified, reproduced, duplicated, copied, sold, resold, visited, stored in or introduced into a retrieval system, or transmitted, in any form, or by any means, or otherwise exploited for any commercial or non-commercial purpose without express written consent of Janco Toys.

Janco Toys makes every effort to keep this website free of harmful elements; Janco Toys does not guarantee that this site or emails sent from our servers are free of viruses or similar harmful files. Janco Toys will not be held liable for any damages of any kind resulting from the use of this site, including but not limited to indirect, direct, coincidental, consequential, and punitive damages. Consequential losses are limited to a) losses that were not foreseeable to both parties when the contract was made, b) losses that were not caused by any breach on the part of the supplier, c) business losses and/or losses to non consumers.
